IDENTIFYING HISTORIC RESOURCES

The Identification Findings Report forms the basis for the "identification" phase of the current Section 106 review for the Ohio River Bridges Project. Information is included to update the identification of historic resources within the original 2003 Project-Specific Area of Potential Effect (APE) and the new 2011 extensions of the Original APE. As part of the next phase of coordination, consulting parties and the project sponsors will focus on assessing the effects that may result from the project and identifying measures to avoid, minimize, or mitigate any adverse effects on historic resources.

Section 1 provides an introduction to recent project activities, an overview of the Original APE and 2011 Extensions to the APE, and key definitions relevant to the Section 106 process.

Section 2 provides updated information on historic properties located within the Original APE. The Original APE encompasses properties that lie near the project footprint and may experience direct impacts (i.e. displacements) or proximity impacts (e.g. noise or vibration). This is a large file and may take a while to download.

Section 3 evaluates whether the Original APE should be extended to account for additional potential effects on historic properties and identifies the limits of these extensions. This is a large file and may take a while to download.

Section 4 provides information on historic properties within the 2011 Extensions of the Original APE, which is the area containing historic properties that may experience indirect effects as a result of changes in traffic patterns. This is a large file and may take a while to download.

REFERRALS TO NRHP KEEPER

At the request of a few consulting parties, two properties have been sent to the Keeper of the National Register of Historic Properties in February 2012 for a final determination of eligibility. The northern field is located just south of Transylvania Avenue in the East End Kentucky portion of the 2003 Original APE; it has been part of both Rosewell and Belleview Farm at different times. The Nuttall House is located at 6900 River Road. FHWA has determined that both of these properties are not eligible for the National Register. FHWA has determined that both of these properties are not eligible for the National Register. The NRHP Keeper concurred in these findings on April 3, 2012 in a response letter to FHWA.

A Letter was sent to the NRHP Keeper regarding the north field with the following attachments:

  • Attachment 1 includes a detailed description of the property’s ownership since 1783.
  • Attachment 2 is a letter from a consulting party requesting that the field be sent to the Keeper for a determination.
  • Attachment 3 is a letter from another consulting party requesting that the field be sent to the Keeper for a determination.
  • Attachment 4 includes 2003 correspondence between FHWA and the KY SHPO on the field’s suggested association with Belleview Farm.
  • Attachment 5 contains excerpts from the 2002 Determination of Eligibility Report for the Project relevant to both Rosewell and Belleview.
  • Attachment 6 includes the National Register form for Belleview.
  • Attachment 7 includes the National Register information for Rosewell, referenced as the Barber-Barbour House.

A Letter was sent to the NRHP Keeper regarding the Nuttall House with the following attachments:

  • Attachment 1 includes a detailed description of the house, its association with W. L. Lyons Jr, and significant renovations in the past decades.
  • Attachment 2 is a letter from a consulting party requesting that the field be sent to the Keeper for a determination.
  • Attachment 3 is a letter from another consulting party requesting that the field be sent to the Keeper for a determination.
  • Attachment 4 includes information on the house when it was resurveyed as part of the January 2010 Survey Update of Butchertown, Phoenix Hill, Downtown Louisville, and River Road.
  • Attachment 5 contains excerpts from the 2002 Determination of Eligibility Report for the Project.
  • Attachment 6 contains the SHPO’s finding from the original 2003 Section 106 process that the Nuttall House is not eligible.
  • Attachment 7 contains correspondence between FHWA and the NRHP Keeper from 2002; at that time, the Keeper determined that the property was not eligible for listing.
  • Attachment 8 contains the KY SHPO’s 2011 concurrence letter on the eligibility of historic resources within the APE for the Project, including the Nuttall House.

ASSESSING EFFECTS

The Effects Findings Report forms the basis for the "effects" phase of the current Section 106 review for the Ohio River Bridges Project. Information is included to identify project effects on historic resources within the original 2003 Project-Specific Area of Potential Effect (APE) and the new 2011 Extensions of the Original APE. Next, consulting parties and the project sponsors will focus on identifying measures to avoid, minimize or mitigate adverse effects on historic resources.

800.11e REPORT

The 800.11e Report for the project summarizes the findings of the Section 106 process that have been completed to date. It includes descriptions of the Project, efforts to identify historic properties, and effects on historic properties. The document also includes a description of input received from Section 106 consulting parties to date. This report satisfies the requirements of 36 CFR 800.11(e).

The report includes three appendices:
Appendix A: Summary of consulting party meetings and correspondence received to date
Appendix B: Identification Findings Report (same as Sections 1-4 listed above)
Appendix C: Effects Findings Report (discussed above)

RESOLVING ADVERSE EFFECTS

The final stage in the Section 106 consultation process is the resolution of adverse effects. The Section 106 Memorandum of Agreement (MOA) summarizes a list of measures the Project team and other responsible parties will undertake as part of the Project to avoid, minimize or mitigate impacts on historic resources. The Original MOA was signed in 2003 and remained in effect until the new MOA was signed.
